LIENS -- TRANSACTIONS -- INFRACTIONS
Aviation Law Center's practice encompasses every essential aspect of aviation law. Our clients have included national and international businesses, located throughout the United States, as well as Canada, Europe and Africa. We have represented individual airmen, air carriers (new entrants and established carriers), aviation fuel companies, aircraft brokers and leasing companies, fixed base operators, repair stations, aerospace companies and aircraft owners in a widely varied array of matters. We have represented start-up companies seeking to enter the airline market.
We have been involved in the sale and purchase of new and used aircraft of every size and type, from airliners to antiques, both fixed-wing and rotary-wing. We assist our clients in every phase of the sale, lease or purchase, from the initial letter of intent to post-closing registrations, and everything in between.
Our knowledge of U.S. and international aviation regulations are invaluable in almost every legal situation involving aircraft . Often, governmental aviation policies with regard to particular issues (such as citizenship requirements, foreign control, wet/dry aircraft leases, noise standards, etc.) have a significant impact on aircraft transactions.
Our Aircraft Lien Program is a proven, effective and inexpensive collection tool for our clients in the aviation service sector. We advise clients on how to obtain and preserve lien rights in aircraft for services rendered. We also assist our clients in perfecting their security interests in aircraft that they have fueled, operated, repaired, serviced and/or stored when the operator fails or refuses to pay. Because a lien on an aircraft record may prevent a title transfer, lease or refinance of the aircraft, and is typically a breach of a lease or financing agreement, the debt usually is satisfied quickly when we notify the aircraft owner, operator and lender of the lien filing.
We have frequently assisted owners, mechanics, fixed base operators and repair stations in resolving disputes which arise in the course of aircraft transactions.
Aviation Law Center has experience drafting liens that meet state, federal and international requirements for validity and enforceability, as well as defending liens that have been improperly filed. We also have sued to enforce existing liens, and assisted in the repossessing or seizing of aircraft subject to valid liens or valid judgments against them.
Aviation Law Center has represented all segments of the aviation field, from private and commercial pilots, aircraft mechanics and fixed-base operators, to commercial airlines, Part 141 operators and airports. Each has its unique circumstances and challenges regarding compliance in the heavily regulated field of aviation. We have represented clients in matters before the FAA, National Transportation Safety Board and TSA. We interact regularly with the local Flight Services Division Offices (FSDOs) in Richmond and Dulles. Whether to head off regulatory compliance problems that are on the horizon, or to deal with regulatory compliance after an infractions occurs, we provide informed and invaluable advice.
We have represented multiple airports in Southeast Virginia, from local airports catering to general aviation to international airports focused on commercial operators. The challenges of each are similar but unique, and can vary widely outside the area of strictly aviation, from employment matters to personal injury claims. We are well-versed in federal and state requirements regarding airport facilities and operations, and work with airport commissions, managers and directors to compassionately and cost-effectively deal with the host of issues airports face.
